The Offer in Compromise (OIC) IRS debt relief program is based on Effective Tax Administration (ETA) protocols.  Congress directed the IRS to create a strategy that allows eligible citizens to negotiate a settlement when they don't qualify for an OIC based on doubt as to liability or collectability.  Congress instructed the IRS to expand its OIC regulations to allow the agency to consider 'additional factors' in determining whether to compromise on a specific debt.
An ETA offer is your IRS debt relief program of last resort.  The IRS's obligations make it clear that an ETA offer will be considered only when there are no grounds for compromise under the concepts of doubt as to liability or doubt as to collectability.  So the ETA offer applies only when it's obvious that you owe the tax and can pay it.

When you owe the tax and can pay it in full, the IRS will consider two additional factors when deciding whether to compromise on your debt.  They are: a.) whether 'collection of the full liability would cause economic hardship' to you and b.) whether there are sufficiently-compelling 'public policy or equity considerations that provide a sufficient basis for compromising the liability.' (Source: Revenue regulations section 301.7122-1(b)(3))  If you can prove that one or both of these conditions apply, the IRS will compromise a debt even though you owe it and can have the ability to pay it.
